Please read these Terms of Use ("Terms") carefully before using the Kasane mobile application ("App"). Your access to and use of the App is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the App.

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the App.

1. Use License

Permission is granted to temporarily download one copy of the App per device for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title. Under this license, you may not modify or copy the materials; use the materials for any commercial purpose or for any public display (commercial or non-commercial); attempt to decompile or reverse engineer any software contained in the App; remove any copyright or other proprietary notations from the materials; or transfer the materials to another person or "mirror" the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Kasane at any time.

2. Disclaimer — Not Medical Advice

The information provided by the App, including AI-generated Focus Plans, habit suggestions, and insights, is for informational purposes only and does not constitute medical advice, diagnosis, or treatment. The App is intended to help you build healthy habits and identify areas you might discuss with a qualified healthcare professional.

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or health objectives.

Never disregard professional medical advice or delay in seeking it because of something you have read or seen in the App.

Reliance on any information provided by the App is solely at your own risk. The AI features may generate information that is inaccurate, incomplete, or outdated. We make no representations or warranties about the accuracy, reliability, completeness, or timeliness of any information provided through the App.

If you think you may have a medical emergency, call your doctor or emergency services immediately.

3. User Responsibilities

You are responsible for maintaining the confidentiality of your device and for restricting access to it. You are responsible for the accuracy of the information you provide to the App. You agree to use the App in compliance with all applicable laws and regulations. You agree not to use the App for any purpose that is illegal or prohibited by these Terms.

4. Third-Party Services (Anthropic)

The App utilizes Anthropic's Claude API to provide AI-powered features. Your use of these features means that certain data (as outlined in our Privacy Policy) is sent to Anthropic for processing. Your interaction with these features is also subject to Anthropic's terms and policies. Kasane is not responsible for the data handling practices or service availability of Anthropic.

5. Intellectual Property

The App and its original content (excluding user-provided data), features, and functionality are and will remain the exclusive property of Kasane and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries.

6. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

7. Limitation of Liability

In no event shall Kasane, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of California, without regard to its conflict of law provisions.

9. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms.

10. Subscriptions and In-App Purchases

Some features of the App are offered through auto-renewing subscriptions or one-time in-app purchases billed through Apple. Billing, free trials, renewals, refunds, and cancellations are handled by Apple under the App Store Terms of Service. You can manage or cancel subscriptions anytime in your Apple ID settings (Settings → Apple ID → Subscriptions). Cancel at least 24 hours before the end of the current period to avoid renewal.

The price, billing frequency, and value of each subscription are presented to you in the App at the point of purchase. Apple, not Kasane, processes payments and handles refund requests in accordance with the App Store Terms of Service. Kasane does not receive or store your payment-method information.
