End-User License Agreement (EULA)

This End-User License Agreement ("EULA") is a legal agreement between you ("User" or "you") and Kasane ("Company," "we," "us," or "our") for the Kasane mobile application, including any associated media, printed materials, and in-app or electronic documentation (collectively, the "App").
By installing, copying, or otherwise using the App, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the App.
1. Grant of License
Subject to this EULA, the Company grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use one copy of the App solely for your personal, non-commercial purposes on a single mobile device that you own or control.
2. License Restrictions
You agree not to, and will not permit others to: license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the App or make it available to any third party; modify, create derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the App; remove, alter, or obscure any proprietary notice of the Company or its licensors; use the App for any unlawful purpose or in violation of any applicable law; or use the App in any manner that could damage, disable, overburden, or impair the App.
3. Intellectual Property Rights
The App, including its structure, organization, code, and documentation, contains valuable trade secrets and confidential information of the Company and its licensors. All rights, title, and interest in and to the App and all associated intellectual-property rights are and shall remain the exclusive property of the Company and its licensors.
4. User Data and Privacy
Your use of the App involves collection and processing of personal and health information as described in our Privacy Policy. By using the App, you consent to such processing and agree to the Privacy Policy.
5. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS," "AS AVAILABLE," AND WITH ALL FAULTS, WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
THE COMPANY MAKES NO WARRANTY THAT THE APP WILL MEET YOUR REQUIREMENTS, BE COMPATIBLE WITH OTHER SOFTWARE OR SERVICES, OPERATE WITHOUT INTERRUPTION, OR BE ERROR-FREE.
THE APP IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE. See the "Disclaimer — Not Medical Advice" section in our Terms of Use.
6. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY, ITS AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR COMPUTER FAILURE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.
KASANE'S AGGREGATE LIABILITY FOR DIRECT DAMAGES SHALL NOT EXCEED THE TOTAL AMOUNTS YOU PAID (IF ANY) FOR ACCESS TO THE APP AND SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
7. Termination
This EULA is effective until terminated. Your rights under this license terminate automatically without notice if you fail to comply with any term of this EULA. Upon termination, you must cease all use of the App and destroy all copies.
8. External Services
The App may enable access to Kasane's and third-party services and websites (collectively, "External Services"). You agree to use the External Services at your sole risk. Kasane is not responsible for examining or evaluating the content or accuracy of any third-party External Services and shall not be liable for any such third-party External Services. Data displayed by any App or External Service, including but not limited to financial, medical, and location information, is for general informational purposes only and is not guaranteed by Kasane or its agents.
You agree not to use the External Services in any manner that is inconsistent with the terms of this EULA or that infringes the intellectual property rights of any third party, and you further agree not to use the External Services to harass, abuse, stalk, threaten, or defame any person or entity. Kasane reserves the right to change, suspend, remove, disable, or impose access restrictions or limits on any External Services at any time without notice or liability to you.
9. Export Restrictions
You may not use or otherwise export or re-export the App except as authorized by United States law and the laws of the jurisdiction in which the App was obtained. In particular, but without limitation, the App may not be exported or re-exported (a) into any U.S.-embargoed countries or (b) to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List. By using the App, you represent and warrant that you are not located in any such country or on any such list. You also agree that you will not use the App for any purposes prohibited by United States law, including the development, design, manufacture, or production of nuclear, missile, or chemical or biological weapons.
10. U.S. Government Terms
The App and related documentation are "Commercial Items," as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation," as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §227.7202-1 through 227.7202-4, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation are being licensed to U.S. Government end users (a) only as Commercial Items and (b) with only those rights as are granted to all other end users pursuant to the terms and conditions herein. 11. Governing Law
This EULA and your use of the App are governed by the laws of the State of California, U.S.A., without regard to its conflict-of-law principles.
12. Severability and Waiver
Severability: If any provision of this EULA is held unenforceable, it will be modified to achieve the intent of the original provision to the maximum extent allowed, and the remaining provisions will remain in full force.
Waiver: Failure to exercise any right under this EULA shall not constitute a waiver of that right or any other rights hereunder.
13. Entire Agreement
This EULA, together with the Privacy Policy and Terms of Use referenced herein, constitutes the entire agreement between you and the Company regarding the App and supersedes all prior agreements.

15. App Store Terms and Apple
This EULA is between you and Kasane, not Apple. Your use of the App must comply with the App Store Terms of Service and the Usage Rules. Apple is not responsible for the App or its contents.
16. Maintenance and Support
Kasane is solely responsible for maintenance and support services for the App. Apple has no obligation to furnish any maintenance or support services.
17. Warranty
To the maximum extent permitted by law, Apple has no warranty obligations with respect to the App. If any warranty applies that cannot be disclaimed, your sole remedy, where applicable, is a refund of the purchase price (if any) by Apple. Otherwise, Kasane is solely responsible for addressing any claims.
18. Product Claims and Intellectual Property
Kasane, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including product liability, legal or regulatory non-compliance, and intellectual property claims.
19. Third-Party Beneficiary
Apple and its subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance of the terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
20. Subscriptions and In-App Purchases
Some features of the App are offered through auto-renewing subscriptions or one-time in-app purchases billed through Apple. All payments are processed by Apple under the App Store Terms of Service. You may manage your subscriptions, free trials, renewals, refunds, and cancellations through your Apple ID account settings (Settings → Apple ID → Subscriptions). Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
The price, billing frequency, and value of each subscription are presented to you in the App at the point of purchase. Apple, not Kasane, processes payments and handles refund requests in accordance with the App Store Terms of Service. Kasane does not receive or store your payment-method information.
This EULA continues to apply to your use of the App whether or not you have an active subscription.
